Subscribing Forest Carbon Sink to Fulfill the Responsibility of Ecological Environmental Restoration

摘要: 以认购林业碳汇的方式来替代履行生态环境修复责任,契合了我国“双碳”战略目标,并能避免当事人在履行生态环境修复责任时可能面临侵权地现实条件不允许或者个人修复能力不足等问题。当受损生态环境无法直接修复时,在符合当事人意愿的前提下,司法机关可以引导当事人通过认购经核证或经各省林业行政主管部门备案的林业碳汇的形式替代履行生态环境修复责任,以达成生态修复目的。这种替代履行应遵循认购程序,并提高社会公众参与度。为防止生态修复赔偿金被不当使用,应建立生态环境评估机制、林业碳汇认购资金管理制度,通过设立银行专项账户、明确资金使用程序对认购金进行管理,并加强对认购资金的监督,从而增强司法实践的可操作性。Abstract: The approach to fulfilling the obligation of eco-environment restoration by purchasing forest carbon sinks as the alternative aligns with China’s “dual carbon” strategy and can help address the challenges that the parties involved may face in fulfilling their restoration responsibilities due to unfavorable local conditions or limited individual capacity. When the damaged ecological environment cannot be restored on site, with the consent of the parties involved, the judicial authorities can guide the parties to fulfill their restoration obligations by purchasing forest carbon sinks that have been verified or registered with the provincial forestry authorities, so as to achieve the goal of ecological restoration. This approach should follow the designated procedures and ensure increased public participation. In order to prevent the inappropriate use of compensation funds for ecological restoration, it is necessary to establish a mechanism for ecological environment assessment and a management system for forest carbon sink subscription funds, the subscription funds will be managed by setting up a designated bank account and specifying the procedures for fund utilization, and more efforts should be taken to strengthen the supervision of the funds use, so as to enhance the enforceability of judicial practices.
